Pennsylvania Statutes 73 P S Section 2232
Summary of the Law:
Who
& What is covered:
Pennsylvania's statute covers any consumer who acquires
a wheel chair by purchase lease, transfer or ability to enforce
the warranty.
Consumer Remedies:
Under the statute, if a wheelchair is in for repair
4 or more times for the same defect or is out of service 30 days
or more within the warranty period, the consumer is entitled to
a replacement assistive device or a refund of the price paid. The
consumer must offer to transfer possession of the wheelchair to
the manufacturer, and the manufacturer then has 30 days to give
a refund of the price paid or a replacement wheelchair to the consumer.
Resale of "lemon" wheelchairs:
Any wheel chair which is repurchased by the manufacturer
because it is a "lemon" under this statute cannot be
resold in Pennsylvania without full disclosure to the consumer.
