Truck Lemon Law
The
Ohio Lemon Law covers any motor vehicle that is designed
to carry 9 or fewer people. It also covers small buses which
are used to carry 15 or fewer people. Even farm trucks (up
to 1 1/2 ton) are covered. Also, used trucks can be covered
by the Ohio Lemon Law.
When it comes to trucks, there are five definitions of what
Lemon Trucks can be.
- First, the manufacturer has to live up to their warranty
for the life of their warranty, no matter how long that
may be. When you have a problem with a truck, and it’s
covered by the warranty, your only obligation is to give
them a chance to fix it. Their obligation is to get it
fixed. If they don’t get it fixed within a reasonable
amount of time or a reasonable number of chances, you can
get to the point where you no longer have any faith in
the reliability of the vehicle or the ability of the dealer
to fix it right. Then, you can say that as far as you are
concerned the warranty has been breached and you want your
money back. You don’t have to let the dealer tinker
around trying to figure it out. Did they fail to get every
defect fixed within a reasonable chance?
Then there are four more tests that all apply during the
first 12 months or 18,000 miles (whichever comes first) after
the vehicle is first delivered new:
- Has the same defect been subject to repair
attempts 3 times and it didn’t get fixed by the end
of the third attempt?
- Has your truck been out of service because of its defects
for a total of at least 30 days?
- Have you had 8 or more different defects in your truck?
- Has there been at least one failed attempt to fix a “deadly” defect
(something that was so serious that it could cause an accident
or someone to get hurt)?
If you answered “yes” to any of these five questions,
then you probably have a lemon truck!
Not all trucks are lemon trucks, but there are other laws
that you can probably use to get you out of a bad truck or
a bad deal.
